Personal Injury

Personal injury law is the legal field that deals with cases where one party causes another party to suffer harm, often as a result of negligence. This field involve injury and/or harm caused by the negligence operation of a vehicle on California roads, slip and falls, injuries caused on the property of another such as a business or a home and injuries caused by the sale of goods that are in some way deemed to be unsafe or unfit of use.

Grandparent Rights​

Generally, a child's parents have the right to decide whether or not their child will see their grandparents. If parents don't live together, either parent can let the child see their grandparents during their parenting time.  In California, under Family Code section 3100, the family court may grant reasonable visitation rights to the grandparent of a minor child. The court may grant you reasonable grandparent visitation rights if either parent of a minor child is deceased. If grandparents file papers asking for visitation, the judge can only order reasonable visitation if they find that 1. There's an existing bond between grandparents and child 2. The child's best interests outweighs parent's rights

Child Custody​

Child custody is a legal term regarding guardianship which is used to describe the legal and practical relationship between a parent or guardian and a child in that person's care. Child custody consists of legal custody, which is the right to make decisions about the child, and physical custody, which is the right and duty to house, provide and care for the child. Physical custody establishes where a child lives and who decides day-to-day issues regarding the child. If a parent has physical custody of a child, that parent's home will normally be the child's legal residence (domicile). The times during which parents provide lodging and care for the child is defined by a court-ordered custody parenting schedule, also known as a parenting plan.

DVRO

A DVRO—also known as a “domestic violence restraining order”—is a type of protection order that is specifically designed to shield victims of family and dating violence. In California, this order can be used to: Restrain an abuser from either direct or indirect contact with you, your children, and/or your property. Restrain an abuser from harassing, stalking, threatening you, or disturbing your peace. Prohibit an abuser from owning a firearm (or ammunition). Order an abuser to leave a home that both of you share. Give a victim temporary child custody (pending the results of a formal child custody hearing). A domestic violence restraining order allows law enforcement to act swiftly in emergency situations, and attaches immediate punishments for any violations.

Marriage/Civil Unions​

Marriage is the legally or formally recognized union of two people as partners in a personal relationship (historically and in some jurisdictions specifically a union between a man and a woman). In California, marriage recognizes the formal union between same sex couples as well. A civil union is a marriage-like relationship, created primarily as a means to provide recognition in law for same-sex couples. In other words, civil union is a legal relationship between two people that provides legal protection to the couple at the state level. The termination of these types of legal unions involves a great deal of legal minutia and detail. Termination of these types of relationship involves the division of property, child custody, finances and a number of other issues that require knowledge of the law and experience to navigate.

Real Estate

Real estate law encompasses the purchase and sale of real property, meaning land and any structures on it. It also covers legal issues related to anything attached to the property or structures, such as appliances and fixtures. Real Estate law can also encompass events related to financial hardship such as foreclosures, short sales or a deed in lieu. 1. A foreclosure is when the bank exercises its right to a home which is used as collateral for a mortgage. When the home buyer can no longer afford the mortgage payment, the bank will accelerate the loan and take ownership of the home as payment for the mortgage owed. 2. A short sale occurs when the bank agrees to allow the purchase of a home to sell the home for less than what is owed because the home owner has fallen on difficult financial times. 3. In the event a short sale is not feasible, and before a foreclosure, the bank can allow a home buyer to deed the home used to secure the mortgage back to the bank willingly in order to satisfy the mortgage. All of these processes contain landmines within a very nuanced set of laws that an experienced Attorney can help navigate the stresses of what is inevitably a stressful time in any person’s life.

Property Settlements​

Part of your divorce involves dividing your property and debts. Property is anything you can buy or sell or has value. For example, a house, car, or furniture. It’s also things like a bank account, pension, retirement account, or stocks. Even if you divided everything informally when you separated, a judge still needs to make a formal order about these issues. This doesn’t mean you have to go to court. A judge could formally approve an agreement you and your spouse write up. If you can't decide, a judge can decide for you at a hearing or trial.
